  • If you cannot be left alone or require intermittent supervision, care or facilitation to complete your activities, the policy contains coverage for "attendant care". Maximums and conditions apply, but family members can be paid for providing this care. Caps apply: $3,000/month for two years for non-catastrophic, $6,000/month to maximum of $1,000,000 for catastrophic
  • Reasonable and necessary medical and rehabilitation expenses undertaken to reduce or eliminate the effects of any disability resulting from the accident as they affect you in your home, your family, your community and your work life are covered up to caps: $100,000 for non-catastrophic and $1,000,000 for catastrophic
  • A dispute resolution system is available when the insurer refuses to pay expenses that you and your treatment providers feel are required.
  • There are Time Frames for applying for benefits and providing various forms to the insurer. Some of these time limits are mandatory, some allow the insurer to delay paying your benefits, some are relaxed if you have a reasonable explanation.

    The insurers also have obligations to respond to applications and pay benefits within specific time frames. You are entitled to be paid interest on overdue benefits.

    You have the right to choose your own service providers, including your case manager. You should consult with a personal injury lawyer, before agreeing to accept the preferred providers of the insurers.

    Potential Claims Against the at Fault Parties

    If your injuries continue to disable you from working, you have the right to sue for additional financial loss. If you have sustained permanent serious disfigurement or permanent serious impairment of an important physical, mental or psychological function as a result of an accident you have the right to sue the parties who were at fault for the accident and collect damages for pain and suffering from their insurers.     Special rules apply to children. If your child was seriously injured or if you see changes in your child's behaviour or school performance after an accident, you should consult your doctor and see a personal injury lawyer right away.

    Select Your Lawyer Carefully

    The results of your insurance claim will have a significant long-term impact for you financially. The more expertise your lawyer has, the better the result is likely to be.

    Most people do not need a lawyer through much of their lives. Many people who are injured in accidents have never used a lawyer before. This lack of experience in dealing with a lawyer makes it difficult for people to choose a lawyer, or to assess the services they are getting from their lawyer.

    What you need is a lawyer who understands his or her way around the system and who knows how to fight back when the insurance company does not fulfill its responsibility. Your lawyer should be able to explain to you throughout the process what is happening. You should feel comfortable that your lawyer knows what the system can provide for you and will work for you to get it. You need a lawyer who can work for you within the insurance and medical systems to help give your treatment direction and to make sure that your injuries and problems are well documented.

    This may be a time of pain, confusion and chaos for you. You need a lawyer with whom you feel comfortable and in whom you feel confident.

    When deciding on your lawyer, don't hesitate to ask for references from former clients. Speak to the hospital discharge planners and/or your rehabilitation treatment providers for their recommendations. Trauma hospitals, rehabilitation hospitals and rehabilitation service providers are usually well acquainted with legal experts in your area. If you have a brain injury, the Ontario Brain Injury Association will provide their recommendations.
